At any firm you will find attorneys who enjoy the products of the wine industry, but very few can match the deep connection that Hudson Martin Ferrante Street Witten DeMaria PC shares with the Monterey and Santa Cruz area wine and hospitality businesses.

Jeannette Witten is managing partner of Hudson Martin Ferrante Street Witten DeMaria PC and founded the firm’s Winery and Vineyard practice group – including the firm’s wine blog:  winelawdecanted.com.  The firm’s Winery and Vineyard group is part of the firm’s expansive Food, Beverage and Hospitality practice. Ms. Witten has worked with Central Coast wineries, vineyards, breweries and distilleries, retail stores, restaurants, resorts and hotels, sports and entertainment facilities, and event management companies for many years. She has particular experience in transactions involving liquor licensing, purchase and sale of wineries and vineyards, formation of LLCs and other legal entities to own and operate wineries and vineyards, preparing and prosecuting trademark applications, obtaining water rights and land use permits and approvals, advising owners on employment and termination agreements with winemakers, drafting and negotiating grape purchase contracts, vineyard leases, crush agreements, and bottling and distribution agreements.  Ms. Witten’s securities background also enables her to assist her wine and hospitality clients in both private and traditional funding.  She has broad experience in business counseling and is known for her thoroughness and effectiveness in complex transactions. Ms. Witten enjoys good food and wine shared with friends. She strives to live each day to the fullest and to that end promotes a firm culture of enjoyment.

In addition to being an attorney, Andrea Upton is an Advanced Sommelier, with seven years of experience in the hospitality and wine industry before becoming a member of the legal profession.  Ms. Upton has worked for leading local and international hospitality companies, importer/distributors, and represented wineries at events throughout Monterey and Santa Cruz Counties.  Ms. Upton also took part in a program in the Carneros AVA where she participated in every aspect of the winemaking process, from picking the grapes to selecting fermentation conditions and barrels for aging the wine. While her focus is now on representing wineries and hospitality businesses in legal matters, Ms. Upton continues to share her passion for the wine industry and keep up with industry news, both for personal interest and to create interesting posts for this blog.  Her practice includes representing businesses in business/corporate law matters, intellectual property, employment/labor issues, and litigation, as well as representing individuals in estate and business succession planning.  Ms. Upton’s intellectual property experience includes domestic and international trademark registration, copyright registration and litigation, licensing agreements and assignments, confidentiality agreements, and advising clients on trade secret protection and litigation.

This combination of passion and experience make Hudson Martin Ferrante Street Witten DeMaria PC uniquely capable of facilitating any legal issues that may arise for a winery or hospitality business.
